PFAS
What Is the PFAS Lawsuit?
PFAS—often called “forever chemicals”—are synthetic compounds used in firefighting foam (AFFF), nonstick cookware, water-repellent fabrics, and food packaging. They persist indefinitely in the environment and accumulate in human tissue. Individuals and communities are suing manufacturers for contaminating drinking water and causing cancer and other chronic illnesses.
Litigation Overview & Case Volume
- An ongoing MDL No. 2873 in the U.S. District Court for South Carolina consolidates nearly 10,400 pending cases, mainly involving AFFF exposure on military bases and airports.
- Claim growth accelerated rapidly, adding over 1,000 cases monthly by mid-2025.
- State lawsuits continue in New Jersey, California, Minnesota, Illinois, and Ohio, filed by state agencies, municipalities, and affected communities.
Key Defendants

Major Settlements
Water System Contamination Cases
- 3M: $10.3B nationwide settlement (over 13 years) with public water systems, final approval in early 2024, disbursements through 2036.
- DuPont, Chemours, Corteva: $1.18B combined settlement resolving water claims from municipalities and water districts.

Historical Personal-Exposure Cases
- DuPont: Settled 3,550 PFOA exposure cases in 2017 for $670.7M; a scientific panel confirmed probable links between exposure and kidney/testicular cancer, thyroid disease, ulcerative colitis, and high cholesterol.
- Combined PFAS-related litigation totals have exceeded $18B by 2024, with corporate reserves exceeding $4B earmarked for future claims.
Health Claims & Scientific Evidence
- Alleged links to kidney, testicular, and bladder cancers.
- Connections to ulcerative colitis, thyroid disease, immune system harm, and developmental damage in children.
- Infertility risks and other reproductive harm.
- Grounded in peer-reviewed studies and the 2004 C8 Science Panel findings identifying probable cancer links.
Litigation Timeline & Next Steps
- MDL (AFFF-related) continues its bellwether and science-day review process.
- The first personal injury trial (testicular and kidney cancer) is scheduled for October 2025.
- Courts have ordered expert disclosure and discovery.
- Classification of ulcerative colitis and other tier-based exposure cases is ongoing.
- New filings include children, pregnant women, and farm communities exposed via contaminated water or consumer products.
